1. Scope
This SMS Messaging Privacy Policy applies to one-time informational text messages sent using SPEAKNOVA's AI-agent and messaging technology.
Messages may be sent by:
- SPEAKNOVA INC.; or
- A participating SPEAKNOVA client business identified in the message.
The business identified in the message is referred to in this policy as the "Message Sender." SPEAKNOVA may provide the technology used to process and deliver the message.
2. How SMS Consent Is Obtained
SMS messages are sent only after the recipient requests or clearly approves receiving specific information by text message.
During a telephone conversation, the AI agent:
- Explains what information will be sent;
- Requests permission to send the information by SMS; and
- Confirms the recipient's mobile telephone number.
Consent is voluntary and is limited to the sender, subject, and information described during the conversation. Consent to receive an SMS message is not a condition of purchasing any product or service.
Consent provided to one business is not transferred to SPEAKNOVA, another client, an affiliate, or another organization.
3. Types and Frequency of Messages
Messages may contain requested or approved information such as:
- Business addresses or operating hours;
- Customer support telephone numbers;
- Appointment or booking links;
- Service, pricing, or plan information;
- Appointment details;
- Answers to customer service questions; or
- Other information discussed during the call.
These messages are not subscription-based. SPEAKNOVA and participating client businesses do not use this process to send unsolicited, bulk, recurring, or automatically scheduled marketing messages.
Message frequency varies based on the number of separate SMS requests or approvals made by the recipient. Typically, one message is sent for each request or approval.
Message and data rates may apply.
4. Information We Process
In connection with SMS messaging, the Message Sender and SPEAKNOVA may process:
- The recipient's mobile telephone number;
- The information requested by the recipient;
- The date, time, and method of consent;
- The business or AI agent that obtained consent;
- Message content and delivery status;
- STOP, START, and HELP requests; and
- Technical and security records associated with message delivery.
5. How Information Is Used
SMS information is used only to:
- Deliver the information requested or approved by the recipient;
- Maintain records of consent;
- Process opt-out and help requests;
- Provide customer support;
- Prevent fraud, abuse, or unauthorized messaging;
- Troubleshoot message delivery; and
- Satisfy applicable legal, carrier, and telecommunications requirements.
6. Mobile Information and Consent Data
Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the text messaging services used solely to deliver and support the requested messages.
Mobile telephone numbers, SMS opt-in information, and messaging consent will not be sold, rented, transferred, or shared with third parties or affiliates for their own marketing or promotional purposes.
A participating client business may use SPEAKNOVA as its contracted messaging technology provider. This processing does not permit SPEAKNOVA or another client to use the recipient's consent for a different sender, purpose, or messaging program.
7. Retention and Security
SMS information is retained only for as long as reasonably necessary to provide the requested service, maintain consent and opt-out records, resolve disputes, prevent misuse, and meet applicable legal or carrier requirements.
Reasonable administrative, technical, and organizational safeguards are used to protect SMS information. However, no electronic communication or storage system can be guaranteed to be completely secure.
8. Opting Out and Requesting Help
Recipients may reply STOP at any time to stop future SMS messages from the applicable Message Sender.
Other recognized opt-out requests may include:
STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, OPTOUT, or REVOKE.
After an opt-out request is processed, one final confirmation message may be sent. No further SMS messages will be sent by that Message Sender unless the recipient subsequently provides new express consent, including by replying START where supported.
Recipients may reply HELP for assistance or contact the business identified in the message.
9. Contact Information
Questions concerning this SMS Messaging Privacy Policy may be submitted through the contact information published on the applicable Message Sender's website.
